el caso de la Rosa (Rosa sp) en Villa Guerrero, Estado de México Vázquez Saavedra, Elda Jimena creator Morales Santos, Tayde directora López Herrera, Agustín asesor Ramírez Díaz, Francisco Javier asesor text theses mx 2012 monographic spa eng xiii, 119 hojas : mapas, gráficas, diagramas, tablas + 1 CD-ROM El desarrollo y uso de la biotecnología en el área agrícola, ha abierto un nuevo campo de inversiones a empresas transnacionales, mejor conocidas en su marco jurídico como empresas obtentoras, dedicadas a la manipulación genética por métodos convencionales obteniendo con ello, nuevas variedades vegetales, que se cotizan alto en los mercados principalmente Maíz (Zea mays) y Rosa (Rosa sp), mismas variedades que pueden ser protegidas legalmente por la modalidad de Derecho de Obtentor y cuya regulación se encuentra establecida en el marco jurídico nacional (Ley Federal de Variedades Vegetales y su reglamento) e internacional (Convenio Internacional para la Obtención de las Variedades Vegetales, Actas 1961, 1972, 1978 y 1991). Sin embargo tal forma de protección ha traído diversos problemas entre obtentores, usuarios y autoridad competente (Servicio Nacional de Inspección y Certificación de Semillas) por el uso del material protegido, debido a una serie de insuficiencias, vacíos e interpretaciones diversas de la legislación nacional e internacional en la materia y hasta por las formas irregulares de acceso al material vegetativo y el respectivo cobro de regalías, así como las intervenciones poco ajustadas a derecho por parte del SNICS. La problemática que aborda el presente trabajo, tiene que ver con esos procesos irregulares y el cobro de regalías excesivas que bajo presunción de piratería, dichas empresas reclaman a los floricultores del municipio de Villa Guerrero, estado de México, principales usuarios del material genético mejorado de Rosa, (plantas completas o partes de ellas). -- The development and the use of biotechnology in the agriculture area, has opened a new opportunity of investments to transnational companies, well known in legal framework as obtentoras companies dedicated to the genetic manipulation by conventional methods getting with that new variety of vegetables getting high value in the market principal Corn (Zea mays) and Rose (Rosa sp) this varieties can be legally protected by the modality of Breeders' Rights duty and that regulation can be found established in the national juridical framework (federal statute of variety vegetables and its regulation) and international (international agreement for the obtaining of new vegetable varieties, articles of incorporation 1961, 1972, 1978 and 1991). However that way of protection has brought many problems with breeders, users and competent authority (National Service of Inspection and Seeds Certification, SNICS) for the use of protected material, due to a number of inadequacies, shortcomings and different interpretations of the national and international legislation in that field, even for the irregular access ways to vegetal material and the cost the royalties also the few intervention of the SNICS.
